OFFICIAL MINUTES OF THE BOARD OF CONTROL
The Board of Control met in
special session on November 28, 2007, via teleconference call, with members
present as follows.
District I -- Terry Kenealy,

District II -- Dr. Bob Reznicek,
District III -- Jay Bellar,
District IV -- Max Kroger, Ord
District V -- Dr. Dallas
Watkins, Dundy County-Stratton
District VI -- Kent Halley,
Mitchell
Dr. Jim Tenopir, Executive Director; Debra Velder, Associate Director; Rex
Schultze, NSAA Legal Counsel; Larry Munksgaard, Lincoln Southeast High School Athletic
Director; Richard Rice, legal counsel; Julie Pell, court stenographer; parents Dave
and Lisa Kastanek and student Marissa Kastanek were also in attendance.
Chairman Dallas Watkins called the meeting to order at 10:00 a.m.
The purpose of the hearing was for Lincoln Southeast High School to seek
Board of Control determination on the domicile change for the legal parents of
student Marissa Kastanek. Following a
presentation of the evidence, those representing the student provided
clarifying information and answers to Board members’ questions.
It was moved by Kent Halley, seconded by Bob Reznicek, to enter
executive session at 11:11 a.m. to discuss evidence regarding verification of a
legal domicile change. Motion
Carried, 6-0. It was moved by Terry
Kenealy, seconded by Kent Halley, to exit executive session at 12:48 a.m. Motion Carried, 6-0.
Based on the Board of Control’s request for
additional clarifying information, the Board of Control recessed the special
telephonic meeting until such information was available.
On Friday, November 30, 2007 at 10:00 a.m.
via teleconference, the Board of Control convened the recessed special telephonic
meeting to deliberate on the request by Lincoln Southeast High School for a determination on the domicile change for the legal
parents of student Marissa Kastanek.
Present on the November 30, 2007 conference call were Board of Control
members Terry Kenealy, Bob Reznicek, Jay Bellar, Max Kroger, Dallas Watkins,
and Kent Halley. Also present were NSAA
Executive Director Jim Tenopir and legal counsel Rex Schultze.
It was moved by Terry Kenealy, seconded by Kent Halley to enter
executive session at 10:05 a.m. Motion
Carried, 6-0. It was moved by Kent
Halley, seconded by Max Kroger, to exit executive session at 10:48 a.m. Motion Carried, 6-0.
On a motion by Terry Kenealy, seconded by Jay Bellar, the Board approved
a finding of fact and determination that Marissa Kastanek’s legal parent had
not made a permanent, bona fide domicile change and that the student would be
ineligible for varsity competition for 90 school days, with that ineligibility
commencing on October 29, 2007. Motion Carried, 6-0.
There being no further business, the meeting adjourned at 11:05 a.m.
